Welcome to Kim Rackham and NouriShe' (“Company,” “we,” “us,” or “our”). By accessing this website or purchasing any coaching services, programs, or digital content, you agree to the following Terms and Conditions. Please read them carefully.

If you do not agree with these terms, please do not use this website or purchase our services.

1. Services Provided

Kim Rackham and NouriShe' provides coaching services, group coaching programs, workshops, and educational resources related to wellness, personal development, nourishment, and lifestyle support.

All services are intended for educational and coaching purposes only and do not constitute medical, psychological, or professional advice.

2. No Medical or Mental Health Advice

Our services are not medical, psychological, or therapeutic services, and we do not diagnose, treat, cure, or prevent any disease or condition.

You acknowledge and agree that:

- Coaching is not a substitute for medical care, mental health treatment, or professional advice

- You are responsible for consulting with qualified professionals regarding your health, mental health, or medical concerns

- Participation in coaching programs is voluntary and at your own discretion

3. Client Responsibility & Assumption of Risk

By participating in our services, you acknowledge that:

- You are responsible for your own decisions, actions, and results

- Coaching outcomes are not guaranteed

- You assume full responsibility for any risks, injuries, or damages that may occur as a result of participation

You agree to listen to your body, honor your limits, and seek appropriate professional care when needed.

4. Payment & Fees

All prices are listed in USD unless otherwise stated.

By purchasing a service, you agree to:

- Pay all fees associated with your selected program

- Authorize us (or our third-party payment processors) to charge your payment method

Payment plans, when offered, must be completed in full. Failure to complete payments may result in suspension or termination of access to services.

5. Refund Policy

All sales are final, unless otherwise stated in writing.

Due to the nature of coaching services and digital content:

- No refunds are provided once services have begun

- No refunds are provided for missed sessions or failure to attend live calls

If a refund policy differs for a specific program, it will be clearly stated on the sales page.

6. Termination

Either party may terminate coaching services by providing at least forty-eight (48) hours’ written notice.

Termination of services does not release the Client from any payment obligations associated with the coaching package selected at the time of enrollment, unless otherwise stated in writing. Access to services, sessions, or materials may be discontinued upon termination.

Written notice of termination must be provided via email or another agreed-upon written communication method.

7. Scheduling & Attendance

For 1:1 coaching:

- Sessions must be scheduled in advance

- Missed or late sessions may be forfeited at our discretion

For group programs:

- Live calls occur at scheduled times

- Attendance is the participant’s responsibility

- Recordings (if provided) are offered as a courtesy, not a guarantee

8. Intellectual Property

All materials provided—including text, videos, worksheets, recipes, and digital content - are the intellectual property of Kim Rackham and NouriShe'.

You may not:

- Reproduce, distribute, or sell any materials

- Share access with others

- Use content for commercial purposes without written permission

9. Confidentiality

We respect your privacy and confidentiality. However, confidentiality is not guaranteed in group coaching environments (e.g., Facebook groups, group calls).

By participating in group programs, you acknowledge:

- Other participants may share or hear personal information

- We are not responsible for breaches of confidentiality by other participants

10. Code of Conduct

We reserve the right to remove any participant who:

- Is disruptive, disrespectful, or harmful to others

- Violates community guidelines

- Engages in harassment, hate speech, or inappropriate behavior

No refunds will be issued if removal is necessary.

11. Limitation of Liability

To the fullest extent permitted by California law, Kim Rackham and NouriShe' shall not be liable for any direct, indirect, incidental, or consequential damages arising from your participation in services or use of this website.

You agree to release, indemnify, and hold harmless Kim Rackham and Nourishe, its owners, contractors, and affiliates from any claims arising from your participation.

12. Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the state or federal courts located in California.

13. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Continued use of this website or services constitutes acceptance of any changes.
